The penalty for not registering under the Shop Act varies for states and is usually monetary or operational and in few cases imprisonment as well. While the monetary values are high, the risk of closure notice always hangs under various non-compliance1.
For example, in Haryana, the penalty for non-registration is provided under section 13 (6) of the Punjab Shops & Commercial Act, 1958 as applicable to the State of Haryana which may be read as under: “In the case of contravention of or failure to comply with the provisions of this section, the employer shall be, on conviction, to fine which shall be not less than one thousand rupees but which may extend to three thousand rupees along with the prescribed registration or renewal fee, as the case may be”
The Shops and Establishment Act regulates the shops and commercial establishments operating within the state. Every state has its own Shop and Establishment Act. However, the general provisions of the Act are the same in all states. The Labour Department of the respective states implements the Shop and Establishment Act. Shops are generally defined under the Act as the premises where the selling of goods take place either by retail or wholesale or where services are rendered to customers. Commercial establishments are generally defined as a commercial, banking, trading or insurance establishment or administrative service in which persons are employed for office work.
The registration fee for Shop Act varies from state to state and depends on the number of workers in the business or establishment. The fee can range from Rs. 1000 to Rs. 10000. The renewal fee is usually half of the registration fee.
The process for obtaining Shop and Establishment Registration Certificate differs from state to state. The proprietor or owner must fill the application form for registration under the Shop and Establishment Act, upload the documents and pay the prescribed fees.
